Slacker, Inc. ("Slacker") understands that it is a privilege to have you as a customer and is committed to protecting your personal information and safeguarding your privacy over the Internet. This privacy policy explains how your personal information and other information will be treated as you use our Website.

Our privacy policy can be summarized as follows:

Aggregate demographic or statistical information that is not personally identifiable may be collected and shared at the discretion of Slacker.

We do not collect personal information from children we know to be under the age of 13, and no part of our Website is directed to children under the age of 13.

If you come to the Slacker website directly from a partner website, we may share your information back with or to the partner which sent you to the Slacker website. Other than this use, we do not share your personally identifiable information unless we have your permission or as otherwise stated in this Privacy Policy.

What kind of information do we collect?

We collect a variety of information for various purposes. We collect personal information, such as your name and email address during your visit to the Slacker Website, in connection with various events such as, but not limited to, sweepstakes or contest entry, or subscribing to receive the Slacker newsletter. Submission of personal information through the Website is voluntary in most cases, and will be collected once you submit it to the Website. If you download software, your name and email information will be required. In addition, to use any aspect of the Slacker Service, you may be required to register and provide certain information including a member or user name, a password, a valid email address (together the "Account Information") or a credit card. We do not collect personal information from children we know to be under the age of 13. We also collect demographic information in a number of other ways. We keep track of the domains from which people visit our Website. For legal and business reasons, we may track the country or zip code of the visitor. We analyze this data for trends and statistics, and for federal export law compliance, when required. This information is analyzed at an aggregate level. Finally, we collect statistical browser information on the anonymous users of our Website, including: (1) the Internet Protocol (IP) address of the user's computer, (2) the referring URL, if any, and/or (3) the browser software identification (this provides the brand and version of the browser software used by the anonymous user while viewing our Website). What are some ways information is collected?

We collect information in several ways. For example, we use IP addresses to analyze trends, administer the site, track users' movement through the site, and gather broad demographic information for aggregate use. IP addresses do not provide us with personally identifiable information such as your name, physical address, email address or telephone number. We use cookies to identify your installation of Slacker software, as well as to identify the version of the software you are currently using. Cookies may also be used to auto-sign you into your account, as well as to store and authenticate your user name and password. Cookies are linked to your personal information so you may not have to sign in and enter a password more than once, thereby saving time while on our site. If you reject the cookie, you may still use our site; however, you will be limited in some areas of our site. Cookies can also enable us to track and target the interests of our users in order to enhance their experience on our site. Rejecting cookies is done on your personal computer and through your browser settings. Finally, web pages may contain an electronic file called a web beacon, which allows a website to count users who have visited that page or to access certain cookies. We research certain usage and activities on our website. Slacker uses web beacons to conduct this research, including on the Slacker website. The information collected through these web beacons is used to find out more about our users, for more accurate reporting, and to improve the effectiveness of our marketing. Information recorded through the use of these web beacons is aggregated. No personally identifiable information about you is shared by us with any person or entity as a result of this research. How do we use the information collected?

Slacker uses the information collected to:
  • Deliver to you and bill you for Slacker Products and Slacker Services, and communicate with you concerning your account and any customer service issues. This may include verifying authorization of credit card usage before access to any subscription for the Slacker Services or your purchase of Slacker Products;
  • Verify access rights to access-restricted services, including for the purpose of supporting digital rights management software;
  • Improve our software and Slacker Services by providing personalized content recommendations, language and location customization, and/or personalized help and instructions;
  • Determine if you meet the minimum system requirements to use the Slacker Products and the Slacker Services, and provide to you information concerning compatibility and interoperability of your system;
  • Track content accesses, downloads and burns for the purpose of paying royalties and license fees to third party providers, such as record labels and other copyright holders and content distributors;
  • Ask you to participate in surveys about the Slacker Products, the Slacker Services, news and events;
  • Offer you Slacker Product upgrades, and Slacker Services for you to purchase;
  • Provide you with content, services, instructions, and a more personalized experience based on personal information, such as your language preferences, zip/postal code, country locations, and any content or other preferences you provide;
  • Auto-update downloaded Slacker Products;
  • Provide you with news, free newsletters, updates, targeted advertising, promotions, and special offers; and
  • Better understand how the Slacker Products are used, including Web traffic patterns and what types of content are most popular with users of Slacker Products and Slacker Services.
  • Share anonymous site usage information about visitors to the Slacker website for the purpose of measuring the effectiveness of affiliate programs. None of such information shared is personally identifiable information.

If you have opted-in to receive e-mails and want us to communicate with you, generally, we send e-mails to you about the Slacker Products and Slacker Services, content and special offers. During registration, you may opt-out of receiving our marketing e-mails and/or newsletters for the relevant product or service, or you can change your settings at any time through the other methods set forth in this Privacy Policy. However, we may continue to send you e-mails about Slacker Products or Slacker Services you have previously purchased, your account status or other information concerning functions, features and status of your Slacker Products and Slacker Services, or to inform you about critical technical service issues relating to a Slacker Product or a Slacker Service.

What information do we share with third parties?

Slacker does not use your personal information for purposes incompatible with those uses listed above. Slacker does not sell, rent, or share your personal information with or to a third party unless you consent to provide such information to a third party partner or content service. Slacker may be required to provide specific access and usage information to certain content providers and rights holders as a condition of content licensing and royalties. In such cases, Slacker may provide content usage, access, demographic and other information without your personally identifiable information (your name, billing information, email address) to the content provider. Slacker may disclose relevant information about our customers to our contractors (e.g. a customer service contractor or a credit card clearing service) in order for them to provide specific services for Slacker, and to better serve our customers. Slacker' contractors are bound by strict contractual requirements to keep all personal information they process strictly confidential and to use such information solely on behalf of Slacker. Slacker may also disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law; (b) comply with an order of a competent judicial authority in any jurisdiction; (c) comply with legal process served on Slacker; (d) protect and defend the rights or property of Slacker; or (e) act in urgent circumstances to protect the personal safety of users of Slacker Products or the public at large. Although we do take (and require our third-party providers to take) commercially reasonable security precautions regarding your personal information collected from and stored by the Slacker Services, due to the open nature of the Internet, we cannot guarantee that any of your personal information stored on our servers, or transmitted to or from a user, will be free from unauthorized access, and we disclaim any liability for any theft or loss of, unauthorized access or damage to, or interception of any data or communications. By using the Slacker Website or the Slacker Services, you acknowledge that you understand and agree to assume these risks.

How do we keep your information secure?

Slacker, Inc. understands that it is a privilege to have you as a customer and is committed to protecting your personal information. We use the following controls to protect your personal information:
  • Use of secure connections using SSL to safeguard information when transmitted from your Web browser to Slacker;
  • Use of security controls to restrict access to databases housing personally identifying information;
  • Use of encryption for sensitive personal information, such as credit card numbers and user names;

How can you access and update your personal information?

To access your account information and your preferences, select "Manage Account" from a link or menus on either the web at www.slacker.com or the Slacker software. Sign in to your account and modify your information and preferences as needed. When you access your account by signing in, you can update and/or make sure that your account information is accurate. If you do not agree to this Privacy Policy, please do not use the Slacker Website or the Slacker Services. Changes to our Privacy Policy.

We may make changes to our privacy policy from time to time. When we do, changes will be reflected directly and immediately in this document so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If, at any point, we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by email.
